How to Change Your Name After Divorce in Louisiana

Your divorce is final, but every card in your wallet still carries your married name. Louisiana handles post-divorce name changes differently from most states because of its civil-law roots, and the path you follow depends entirely on what your judge included in the final judgment.

Here is the exact process, the costs, and the order that actually works with Louisiana agencies.

Two Paths: Name Confirmation vs. Independent Petition

Louisiana does not automatically restore your former name when a divorce is granted. Under Code of Civil Procedure Article 3947, a marriage does not legally change your surname — you simply used your spouse's name during the marriage. Upon divorce, the court may enter an order "confirming" your name, but only if you or your attorney drafted that language into the final judgment.

Path 1 — Name confirmation in the decree. If your final judgment already contains language confirming a permitted surname — the surname used at marriage, the surname of a spouse's minor child, or the surname on your birth certificate — you can skip the courthouse entirely and go straight to updating federal and state ID.

Path 2 — Independent petition under La. R.S. 13:4751. If the name-confirmation language was omitted from your decree, you must file a separate petition in the parish of your birth, current residence, or through the Vital Records Registry in Orleans Parish. Serve the District Attorney, complete the mandatory criminal background check, and attend the court hearing. Filing fees vary by parish — typically $300 to $400, with possible service-of-process costs.

If the decree lacks the name-confirmation language, follow the separate petition route under La. R.S. 13:4751; the administrative path cannot substitute for that order.

The Mandatory Update Sequence

Louisiana agencies require you to update documents in a specific order. Skipping ahead causes rejections.

Step 1 — Social Security Administration. Submit Form SS-5 with your certified divorce decree containing the name-confirmation language, a valid photo ID, and proof of citizenship. There is no fee. You can apply at any Louisiana SSA office or by mail. Wait at least 24 hours after processing before moving to the next step — the OMV uses the SSA record for verification.

Step 2 — Office of Motor Vehicles (within 30 days). Bring your SSA confirmation letter, certified decree, current license, two proofs of Louisiana residency, and proof of vehicle insurance. Fees range from $13 to $33 depending on the parish, plus a convenience fee if you use a public tag agent. Louisiana law requires this update within 30 days of the name change.

Step 3 — U.S. passport. If both your most recent passport issuance and legal name change are less than one year old, mail Form DS-5504 with your certified decree, existing passport, and a new photo; no name-change fee applies. Otherwise, check whether you qualify for Form DS-82 or apply with Form DS-11 for an adult passport book. Standard fees are $130 for DS-82 and $165 for an adult passport-book DS-11 application.

Step 4 — Voter registration. Update online through the GeauxVote portal or submit a paper application to your local Registrar of Voters. No fee. Must be completed before the close of voter registration for any upcoming election.

Common Rejection Points

The SSA will reject your application if:

• You bring a photocopy or notarized copy instead of a custodian-certified copy from the parish Clerk of Court
• Your decree mentions your married name but does not explicitly restore your prior name
• Your supporting ID has expired

The OMV will reject your application if you arrive before your SSA record has been updated (the 24-hour waiting period matters) or if you cannot show current Louisiana residency.
